Terms of Use

By using the National Marrow Donor Program® (“NMDP”) Intranet (the “Intranet”), you agree to be bound by the Terms of Use stated below.  All Intranet users (“users”) are required to read, understand, and strictly comply with the Terms of Use. A user acknowledges full understanding and agreement to comply with the Terms of Use when the user chooses to access the Intranet. If you do not agree to these Terms of Use, you must not access or use the Intranet. The Terms of Use cover the following main areas:

Access Rights

Only individuals employed by the NMDP/Be The Match may be granted permission to access the Intranet. In addition, at the sole discretion of NMDP/Be The Match Senior Management (which for the purposes of these Terms of Use shall mean an NMDP/Be The Match Officer, Vice President, or Director), in consultation with the NMDP/Be The Match Intranet administrator, certain independent contractors or temporary employees may be granted access to the Intranet. NMDP/Be The Match Senior Management holds the final right to grant or deny access to the Intranet to any user without prior notice.

Rules of Conduct

While using the Intranet, users must comply with all applicable laws, rules, regulations, and NMDP/Be The Match policies and procedures, including but not limited to NMDP/Be The Match employment policies. This means, among other things, that users must access and utilize the Intranet with common sense, goodwill, and respect for others. Improper use of the Intranet may subject a user to discipline, up to and including termination of employment or contractual relationship with the NMDP/Be The Match or Be The Match Foundation.

Information Use and Security

Information, material, and content contained within the Intranet is restricted to NMDP/Be The Match internal use only. A user may use materials and content on the Intranet only for purposes related to the fulfillment of the user’s job duties and responsibilities. The disclosure, distribution, republication, or sharing of any information contained on the Intranet with individuals or entities other than authorized Intranet user(s) is strictly prohibited without prior approval of NMDP/Be The Match Senior Management.  This includes framing or mirroring any part of the Intranet, systematically downloading and storing any content, putting the content in a database, or republishing it to any person or persons in any form. Users are prohibited from releasing any Intranet user ID, password, or password-related information to any individual or entity other than the Intranet administrator.

Ownership of Intranet Content

Unless expressly stated otherwise, copyright and all other intellectual property rights in all material and content on the Intranet are owned by the NMDP/Be The Match. Materials and information contained on the Intranet may not be reproduced in whole or in part without prior written permission from the NMDP/Be The Match, unless such reproduction is properly made in the course of a user’s fulfillment of his/her job duties and responsibilities and is in compliance with these Terms of Use. For information about obtaining permission to use copyrighted materials and trademarks owned by the NMDP/Be The Match for purposes other than those expressly provided for within these Terms of Use, see Copyright and Trademark Information.

Content Management

NMDP/Be The Match Senior Management, in consultation with the Intranet administrator, holds final and sole decision-making authority regarding the posting and/or removal of any content or materials at any time without prior notice. The NMDP may change or remove, either temporarily or permanently, the Intranet or any part of it at any time and without prior notice.

Medical Disclaimer

Information contained on the Intranet is not a substitute for a doctor’s medical judgment or advice. The NMDP/Be The Match recommends that specific, individual health concerns be discussed with the individual’s physician or health care professional. Any medical materials and discussions presented on the Intranet describe current treatment options and drugs or treatments that may be under study, and are for informational purposes only. Treatment options or donation procedures should be determined by an individual and his or her treating physician based on the individual’s overall health, age, disease, disease stage, and, if transplant is being considered as a treatment option, the availability of a suitably matched donor or cord blood unit.

Changes to Terms of Use

The NMDP/Be The Match may change these Terms of Use at any time by posting the changed Terms of Use on the Intranet. All terms are automatically effective as soon as they are posted.
